Is it permissible for a woman to use her sister’s womb for surrogacy?
QUESTION:
A woman is unable to get pregnant, is she permitted to utilise her sister’s womb for pregnancy?
ANSWER:
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
Shari’ah emphasises greatly upon the preservation of lineage. [1]
Thus, the involvement of a third person in reproduction (surrogacy) is totally forbidden. [2]
Alternatively, one may consider adoption, which is indeed highly-praiseworthy. However, at no point should the orphan’s lineage be attributed to the adoptive parents. [3]

قائم مقام ماں جس کے صورت یہ ہے کہ مرد کا مادہ لے کر بجاۓ بیوی کے کسی اجنبی عورت کو بطور اجیر حاصل کر کے رحم میں انجکشن سے پہونچایا جاتا ہے وہ عورت حاملہ ہوجاتی ہے، اس صورت کا کیا حکم ہے؟
ب: وہ اجنبیہ عورت جس کے رحم انجکشن سے شوہر کے علاوہ کسی کسی مرد کا مادہ منویہ پہونچایا گیا ہو وہ عورت عقلِ سلیم کے نزدیک مزنیہ اور طوائف سے بھی زیادہ فاحشہ قرار پاۓ گی اور اس کے شناعت عقلِ سلیم کے نزدیک زنا سے بھی زیادہ قبیح ومذموم ہے۔
