Is it permissible to work in the HR department of a corporate law firm?

QUESTION:

I’m attempting to decide if my current job that I have is Haram or not. I work as an HR Administrator for a legal business – a corporate law firm that provides legal advice for different companies. The company is large and it has a number of different teams, which specialise in providing different areas of legal advice, such as, Professional Indemnity, hospitality and catering, casualty and occupational health, insurance, banking, costs, technology, police and prisons….As I work in the HR department, I’m not the one providing the legal advice to the different branches, but I’m doing HR Admin for the lawyer. Is my job Halal?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Firstly, we applaud you for your sincere concerns towards ensuring a halāl income.

As indicated in your question, your position in the HR Department at the Corporate Law firm is merely of an administrative nature [1] and generally free from any sinful activity, [2] whereby you are not directly involved in any legal matters. Thus, your income will be halāl. [3]

ولا يجوز الاستئجار على الغناء والنوح، وكذا سائر الملاهي؛ لأنه استئجار على المعصية والمعصية لا تستحق بالعقد

والإستئجار على المعصية لا تجوز

وإن كانت معصية كالنياحة والغناء فهو إجارة على المعصية، والإجارة على المعاصي باطلة

[Muhīt al-Burhānī: Dār al-Kutub al-'Ilmiyyah: 7:483]

اور چونکہ یہ تجارت یعنی بجلی تیار کر کے اہل حاجت کے ہاتھ فروخت کرنا جائز ہے، اس لۓ اس کا نفع وغیرہ بھی حلال ہے۔

صرف وہ مدد ناجائز ہے ہے جو براہ راست حرام کام میں ہو مثلا سودی معاملہ کرنا، سود کا معاہدہ لکھنا، سود کی رقم وصول کرنا وغیرہ۔ لیکن اگر براہ راست سودی معاملے میں انسان کو ملوث نہ ہونا پرے (إلی قوله)
تو اس میں چونکہ براہ راست مدد نہیں ہے، اس لۓ گنجائش ہے۔

Note: There is an additional matter to be considered in some cases: If the income sources of the company/firm are mixed between lawful and unlawful sources and it’s difficult to differentiate between the two, then the majority will be considered. If the majority income is unlawful, various scholars explicitly state that this is ‘assisting in sin’ and thus, impermissible.

اس نصوص سے معلوم ہوا کہ جس شخص کی امدنی حلال اور حرام سے مخلوط ہے، اس میں غالب کا اعتبار ہوگا۔

 اگر حلال وحرام آمدن کو خلط کر دیا جاتا ہے اور حلال کو الگ رکھنے پر ادارہ تیار نہ ہو تو اس کا حکم یہ ہے: حلال وحرام مخلوط ہوں لیکن حلال غالب ہو تو اس سے اجرت لینا جائز ہے اور اگر حلال وحرام دونوں برابر ہوں یا حرام غالب ہوں تو جائز نہیں. انتهى.

جہاں تک حرام مال سے تنخواہ ملنے کا تعلق ہے، اس کے بارے میں شریعت کا اصول یہ ہے کے اگر  ایک مال حرام اور حلال سے  مخلوط ہے ہو اور حرام مال زیادہ ہو تو اس سے تنخواہ یا ہدیہ لینا جائز نہیں، لیکن اگر حرام مال کم ہو تو جائز ہے۔
