Is it permissible to visit the graves of the pious?

QUESTION:

A person travels to Ajmer and other places with the intention of visiting the graves of the pious. He travels with this very intention, but makes sure he stays away from all types of evils and he views going to these places as a means of reward. Is this permissible?

ANSWER:

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In essence, it is permissible for an individual to visit the graves of pious individuals, without making it a regular practice and, especially, during a time when there are no innovations or impermissible acts occurring.

However, considering the ongoing innovations and violations that occur at some of these sites, it would be unsuitable for the scholars of a community to be seen frequently visiting such sites.

وَفِي الْحَدِيثِ الْمُتَّفَقِ عَلَيْهِ «لَا تُشَدُّ الرِّحَالُ إلَّا لِثَلَاثَةِ مَسَاجِدَ: الْمَسْجِدِ الْحَرَامِ، وَمَسْجِدِي هَذَا وَالْمَسْجِدِ الْأَقْصَى» " وَالْمَعْنَى كَمَا أَفَادَهُ فِي الْإِحْيَاءِ أَنَّهُ لَا تُشَدُّ الرِّحَالُ لِمَسْجِدٍ مِنْ الْمَسَاجِدِ إلَّا هَذِهِ الثَّلَاثَةِ لِمَا فِيهَا مِنْ الْمُضَاعَفَةِ، بِخِلَافِ بَقِيَّةِ الْمَسَاجِدِ فَإِنَّهَا مُتَسَاوِيَةٌ فِي ذَلِكَ، فَلَا يُرَدُّ أَنَّهُ قَدْ تُشَدُّ الرِّحَالُ لِغَيْرِ ذَلِكَ كَصِلَةِ رَحِمٍ وَتَعَلُّمِ عِلْمٍ وَزِيَارَةِ الْمَشَاهِدِ كَقَبْرِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - وَقَبْرِ الْخَلِيلِ - عَلَيْهِ السَّلَامُ - وَسَائِرِ الْأَئِمَّةِ

قُلْت: اُسْتُفِيدَ مِنْهُ نَدْبُ الزِّيَارَةِ وَإِنْ بَعُدَ مَحَلُّهَا. وَهَلْ تُنْدَبُ الرِّحْلَةُ لَهَا كَمَا اُعْتِيدَ مِنْ الرِّحْلَةِ إلَى زِيَارَةِ خَلِيلِ الرَّحْمَنِ وَأَهْلِهِ وَأَوْلَادِهِ، وَزِيَارَةِ السَّيِّدِ الْبَدَوِيِّ وَغَيْرِهِ مِنْ الْأَكَابِرِ الْكِرَامِ؟ لَمْ أَرَ مَنْ صَرَّحَ بِهِ مِنْ أَئِمَّتِنَا، وَمَنَعَ مِنْهُ بَعْضُ أَئِمَّةِ الشَّافِعِيَّةِ إلَّا لِزِيَارَتِهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قِيَاسًا عَلَى مَنْعِ الرِّحْلَةِ لِغَيْرِ الْمَسَاجِدِ الثَّلَاثَةِ. وَرَدَّهُ الْغَزَالِيُّ بِوُضُوحِ الْفَرْقِ، فَإِنَّ مَا عَدَا تِلْكَ الْمَسَاجِدَ الثَّلَاثَةَ مُسْتَوِيَةٌ فِي الْفَضْلِ، فَلَا فَائِدَةَ فِي الرِّحْلَةِ إلَيْهَا. وَأَمَّا الْأَوْلِيَاءُ فَإِنَّهُمْ مُتَفَاوِتُونَ فِي الْقُرْبِ مِنْ اللَّهِ - تَعَالَى، وَنَفْعُ الزَّائِرِينَ بِحَسَبِ مَعَارِفِهِمْ وَأَسْرَارِهِمْ. قَالَ ابْنُ حَجَرٍ فِي فَتَاوِيهِ: وَلَا تُتْرَكُ لِمَا يَحْصُلُ عِنْدَهَا مِنْ مُنْكَرَاتٍ وَمَفَاسِدَ كَاخْتِلَاطِ الرِّجَالِ بِالنِّسَاءِ وَغَيْرِ ذَلِكَ لِأَنَّ الْقُرُبَاتِ لَا تُتْرَكُ لِمِثْلِ ذَلِكَ، بَلْ عَلَى الْإِنْسَانِ فِعْلُهَا وَإِنْكَارُ الْبِدَعِ، بَلْ وَإِزَالَتُهَا إنْ أَمْكَنَ

اگر کوئی محظور شرعی نہ پایا جائے تو کسی بزرگ کے مزار پر حاضری شریعت میں ممنوع نہیں ہے، اور فقہاء کے کلام سے اس مقصد کے لئے سفر کی اجازت بھی معلوم ہوتی ہے۔
