Khula` during Menses

Shortened Question:

Is khula` permissible in menses?

Question:

Is khula` allowed if a woman is in her haidh?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It is permissible to issue a khula` while the woman is in her menses.[1]

ثم ذكر عن المحيط أن الخلع في حالة الحيض لا يكره بالإجماع لأنه لا يمكن تحصيل العوض إلا به. اهـ.

والخلع لا يكون إلا عند تحقق الحاجة وبلوغها النهاية ولذا روي عن الإمام أن الخلع لا يكره حالة الحيض كذا في فتح القدير وذكر الإسبيجابي أن الخلع لا يكره كما لا يكره حالة الحيض بالإجماع وعلله في المحيط بأنه لا يمكن تحصيل العوض إلا به اهـ.

والخلع لا يكون إلا عند تحقق الحاجة وبلوغها النهاية ولها روى عن أبي حنيفة أن الخلع لا يكره حالة الحيض

والخلع سني كان في حالة الحيض أو في غير حالة الحيض وفي المنتقى ولا بأس بأن يخير امرأته في الحيض ولا بأس لها أن تختار نفسها في الحيض وفيه أيضا إذا أدركت واختارت نفسها فلا بأس للقاضي أن يفرق بينهما في حالة الحيض هكذا في المحيط والأمة إذا أعتقت فلا بأس بأن تختار نفسها وهي حائض وكذلك إذا مضى أجل العنين وهي حائض كذا في شرح الطحاوي المدخولة وغيرها سواء في هذه المسائل هكذا في السراج الوهاج
