http://www.askimam.or/public/question_detail/27215 I wish to clarify the question with the following details:

  • The client pays my company, not me, on a per-hour basis (i.e. the client pays my company for every hour of my time).
  • I receive my salary on a monthly-basis, from my own company, not from my client. This salary is not computed on an hourly-basis.
  • I do not receive any compensation/ bonus from the client for my work.
  • I am entitled to some leaves as part of our company policy. These are deducted from my account whenever I take a leave. I always report my leave to my manager and in my company`s time-reporting system.
  • I am asked by my manager to not report my leave hours to the client and to report my hours as “working” for the full week. Please let me know what my responsibilities in this situation are.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

According to our understanding, you are paid on a monthly basis by your own company and not on an hourly basis from the client.

As you have entered into an agreement with your own company that you will be paid on a monthly basis, you are entitled to the remuneration from your own company as promised on a monthly basis regardless of the hours you work or report to the client. Whether you report your true working hours or not does not have an implication on your salary since you are paid by your own company on a monthly basis and not hourly[1].

However, you must approach your manager and explain to him your aversion to lying and not reporting the correct hours. Prophet Muhammad (peace be upon him) said:

There is no obligation in obeying the creation in the disobedience of Allah[2].

As Muslims we must be truthful in our statements and dealings. Keep faith in Allah and Allah will ease your difficulty and open all avenues. Allah Ta`ala says:

ومن يتّق الله يجعل لّه مخرجا ، ويرزقه من حيث لايحتسب ، ومن يتوكّل علي الله فهو حسبه

Translation: and whosoever fears Allah, He will make a way for him to get out (from every difficulty). And he will provide him from sources he could never imagine. And whosoever puts his trust in Allah, then He will suffice him[3].

(قوله وليس للخاص أن يعمل لغيره) بل ولا أن يصلي النافلة. قال في التتارخانية: وفي فتاوى الفضلي وإذا استأجر رجلا يوما يعمل كذا فعليه أن يعمل ذلك العمل إلى تمام المدة ولا يشتغل بشيء آخر سوى المكتوبة وفي فتاوى سمرقند: وقد قال بعض مشايخنا له أن يؤدي السنة أيضا. واتفقوا أنه لا يؤدي نفلا وعليه الفتوى. وفي غريب الرواية قال أبو علي الدقاق: لا يمنع في المصر من إتيان الجمعة، ويسقط من الأجير بقدر اشتغاله إن كان بعيدا، وإن قريبا لم يحط شيء فإن كان بعيدا واشتغل قدر ربع النهار يحط عنه ربع الأجرة. (قوله ولو عمل نقص من أجرته إلخ) قال في التتارخانية: نجار استؤجر إلى الليل فعمل لآخر دواة بدرهم وهو يعلم فهو آثم، وإن لم يعلم فلا شيء عليه وينقص من أجر النجار بقدر ما عمل في الدواة
