Does ‘no longer wanting a marriage‘ constitute a divorce?

Question:

Does it count as a talaq when husband says he no longer wants our marriage or me because he was upset with something that happened?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

It will constitute a divorce if there was an intention of divorce by uttering those words.

فالحالات ثلاث: رضا وغضبا ومذاكرة، والكناية ثلاث: ما يحتمل الرد، أو ما يصلح للسب، أو لا ولا. فنحو اخرجي، وإذهبي، وقومي.......يحتمل ردا و نحو خلية،بريّة، حرام، بائن و مراد فها كبتة، بتلة يصلح سبا.......و في الغضب توقف الأولان إن نوي وقع وإلا لا.

و في الشامي: والحاصل أن الأول يتوقف علي النية في حالة الرضا والغضب والمذاكرة والثاني في حالة الرضا والغضب فقط

[ad-Durr al-Mukhtar ma‘a Radd al-Muhtar, 4: 528, Maktabah Zakariyya]

"والحاصل ما في الخانية ان من الكنايات ثلاث بعشرة لا يعتبر فيها دلالة الحال ولا تقع إلا بالنية.......قومي اخرجي اذهبي انقلي، انطلقي، تزوجي، اغرببي، لا نكاح لي عليك".

[al-Bahr ar-Ra‘iq, 3: 526, Maktabah Zakariyya]

"أما الكنايات فنوعان: أما النوع الأول فهو كل لفظ يستعمل في الطلاق ويستعمل في غيره ونحوه قوله.......لا نكاح لي عليك، قومي،اخرجي،.......تزوجي، إبتغي الأزواج.......فافتقرت ألي النية لتعيين المراد".

[Bada‘i as-Sana‘i, 3: 168-9, Maktabah Zakariyya]

"لو قال: ما أنت لي بامرأة و ليست لك بزوج، ونوي الطلاق يقع عند أبي حنيفة"

[al-Fatawa al-Hindiyyah, 1: 375, Zakariyya]

"یہ کنایات اس قسم سے ہیں جو محتمل رد وجواب اور محتمل سب وجواب ہیں اور حالت ہے غصب کی اس لۓ مدار وقوع طلاق کا نیت پر ہوگا اگر طلاق کی نیت کی ہے تو طلاق بائن ہو گی اور اگر نیت نہ کی تو کچھ نہ ہوگا اور وقوع کی صورت میں اگر تینوں لفظوں میں جدا گانہ کی ہے تو تین طلاق واقع ہوںگی۔۔۔۔۔۔۔۔"

"بر تقدیر صحت سوال اگر خلیل احمد نے اپنی بیوی کو طلاق کی نیت سے یہ الفاظ کہے ہں "میں اس کو بیوی نہیں مانتا" تو اس سے ایک طلاق بائنہ واقع ہوئی۔۔۔۔۔۔۔۔۔۔۔"
