Using Waqf Property

What are the rulings pertaining to Waqf?

Question:

I trust that Mufti Saheb is well, and pray that Allah (SWT) protects Mufti Saheb always.

A: My query relates to Waqf property: At the Masjid we have many items that may be removed from the Masjid, and occasionally we have requests to loan these items out, or rent them out, for example:

  1. We have some loose carpet (rolls), and brothers request to use these at home for a private Khatam, or use during some occasion at home, or when opening a new shop. The donors originally donated these to our Jamaat Khana, before we moved to the Masjid. Up to now we have been letting people use these carpets, but recently the requests are more frequent.
  2. Brothers sometimes want to borrow Qur`ans, or other Books belonging to the Masjid (Waqf).
  3. Sometimes a request for a private function, for example, a child is graduating Hifz, and the parents want to invite family and friends (not Aam), and request to use the Madrassah hall. Is this in order? Can we rent it out? The Masjid is used for a general talk for the men (open to the public).
  4. Occasionally the ladies group (independent from the Trust), have a guest speaker, or some programme, and use the utensils and equipment from the Masjid if they have meals as well. On the last occasion an Urn went missing, but was replaced. The Trustees only became aware of this matter after the event. Everything is now locked, but I am sure that a request will come when another event comes up. These events are usually held at a private hall, not at the Masjid, since generally not supported by the Trust.
  5. How do we dispose of surplus or redundant Waqf property? Can we appoint one of the Trustees to set a price, and sell the items? May we set the price way below market value, so that the time items are sold quickly?

B: A further query regarding the Masjid, if brothers sit for Nafil I`tikaaf, is it proper that they take meals in the Masjid as well?

At the outset, we apologise for the belated response. Issues of Waqf are delicate and require intense research.

In order to answer your query, it is important to first understand the basic difference between a regular donation and a Waqf property.

In principle, donations received by the Masjid are divided into three categories:

Zakah and Sadqah: Zakah and Sadaqah are usually monetary donations given to the Masjid so that they may be dispersed to the proper recipient of Zakah.[1] Such funds may not be utilized for private use by the Masjid.[2]

Waqf: A Waqf property refers to any item or property permanently donated in the path of Allah to the Masjid for use by the Masjid and its Musallees. The trustees of the Masjid may utilize the Waqf property for the use and benefit of the Masjid[3] as intended by the Waqif (donor) but may not claim ownership of such a property.[4] As such, the use of such a property is restricted to the Masjid and in normal cases, may not be sold or borrowed out to another[5] without any charge. Although, if the need arises (e.g. the property becomes old or is no longer used), the property may be leased out[6] or sold and the proceeds of the sale may be used for the purpose of the Masjid.[7]

Donations: In terms of non monetary donations, “donation” here refers to any item or property handed over to the Masjid for temporary use by the Masjid or its Musallees.[8] Such a donation remains in the ownership of the original owner and may be utilized in any way intended by the donor. As such, such an item or property may be sold, moved, or borrowed out to another at the discretion of the original donor.[9] Monetary donations made for use by the Masjid also fall in this category and may be used in any way intended by the donor.[10]

 

Here under are the answers to your queries in question:

A:

  1. If the carpets were donated to the Jamaat Khana then they will not be considered as Waqf As such, the ownership of the carpets will belong to the original donors and will not belong to the Masjid. The trustees may seek clarity from the donors on whether the carpets now belong to the Masjid as Waqf property. If so, it is impermissible to allow people to borrow these carpet rolls[11] [12].
  2. It is impermissible for an individual to remove the Qur`an or other books of Waqf from the Masjid for personal use.[13]
  3. It is permissible to lease out the hall to generate revenue[14]. However, the trustees should ensure the function does not entail any violations of Sharia.
  4. The same rule as to question one will apply here. The trustees may seek clarity from the donors on whether the utensils now belong to the Masjid as Waqf property. If so, it is impermissible to allow people to borrow these utensils. However, these utensils and equipment can be given out for use after seeking permission and approval from the donors[15]. The trustees may engineer a mechanism to overcome the exploitation of this facility.
  5. It is permissible to sell the surplus and redundant property, at a price mutually agreed by the Trustees,[16] and use the money therefrom for the purpose of the Masjid[17].

B: It is correct, in fact a requirement, for a Mu`takif to take his meals in the Masjid[18].

حشيش المسجد وحصره مع الإستغناء عنهما، وكذا الرباط والبئر إذا لم ينتفع بهما، فيصرف وقف المسجد والرباط والبئر والحوض إلى أقرب مسجد أو رباط أو بئر أو حوض إليه

[13] أما وقف المنقول مقصودا فإن كان كراعا أو سلاحا يجوز فيما سوى ذلك إن كان شيئا لم يجر التعارف بوقفه كالثياب والحيوان لا يجوز عندنا وإن كان متعارفا كالفأس والقدوم والجنازة وثيابها وما يحتاج إليه من الأواني والقدور في غسل الموتى والمصاحف لقراءة القرآن قال أبو يوسف - رحمه الله تعالى -: إنه لا يجوز، وقال محمد - رحمه الله تعالى -: يجوز، وإليه ذهب عامة المشايخ رحمهم الله تعالى منهم الإمام السرخسي كذا في الخلاصة وهو المختار والفتوى على قول محمد - رحمه الله تعالى -، كذا قال شمس الأئمة الحلواني كذا في مختار الفتاوى ....

ثم في وقف المصحف إذا وقفه على أهل المسجد يقرءونه إن يحصون يجوز وإن وقف على المسجد يجوز أن يقرأ في هذا المسجد وذكر في بعض المواضع لا يكون مقصورا على هذا المسجد كذا في الوجيز للكردري.

واختلف الناس في وقف الكتب جوزه الفقيه أبو الليث وعليه الفتوى كذا في فتاوى قاضي خان إذا جعل ظهر دابته أو غلة عبده في المساكين لا يصح في قول علمائنا كذا في المحيط.
