what is the ruling on Talaq Ba’in?

Shortened Question:

Can more than one Talaq-e-Ba`in be given at one time?

Question:

As-Salamu Alaykum Mufti, I have one more question on Talaq-e-Ba`in. If husband issues more than one Talaq-e-Ba`in on different occasions within the Iddah do all Talaq-e-Ba`ins count? If husband says Talaq-e-Bain in the same setting more than once do all count or just the first one?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If the husband utters any ambiguous (Kinayah) statements, such as “I have separated from you” and other statements recorded in the query, intending divorce, then one irrevocable divorce (Talāq Bā’in) will take place[1].

In both cases referred to in the question, if the husband issues more than one Talaq Ba`in using separate sentences either within the same setting or on different occasions within the iddah period, then only the first Talaq will fall and now the husband and wife will not remain in Nikah and thus all other subsequent Talaq Ba`in will be void[2]. However, the husband and wife thereafter may mutually agree to remarry each other within or after the Iddah period[3] if the husband did not issue two divorces previously.
