Masah over the feet

 

Shortened Question:

What is the basis of masah upon the Jawrabain?

Can the Qur`anic verse facilitate performing masah over, as well as washing, the feet?

Question:

Is it true that Imam Abu Hanifa additionally [to Qiyas] used the Hadith of Mughira ibn Shu`bah and Qaiys to establish his opinion on Masah upon the Jawrabain? – Al-Sarakhsi apparently mentions it.

Also the command of the Qur`an to wash the feet is definitive, but Arjul can be `Atf of Masah in another Qira`at, so it would not in that case contradict the Qur`an?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

At the outset, it must be pointed out that Imam Abu Hanifah (may Allah have mercy on him) always preferred Hadith, even though it may be a weak Hadith, over Qiyas.

Secondly, the substantiations of the Hanafi Fiqh quoted in the books of Fiqh, such as al-Hidayah, are not the direct quotations and substantiations of Imam Abu Hanifah (may Allah have mercy on him) himself but were understood afterwards by the later Jurists.

We assume that you are a student of Hadith or Fiqh, and accordingly, hereunder is our response:

The Hadīth mentioned in reference is as follows:

عن المغيرة بن شعبة قال: توضأ النبي صلى الله عليه وسلم ومسح على الجوربين والنعلين

Translation: Prophet (peace and salutations be upon him) performed ablution and wiped over his “Jawrabain” and sandals.

This narration can be also found on the authority of Abu Musa (may Allah be pleased with him) and as a practice of Abdullah ibn Mas`ud[1] (may Allah be pleased with him). The narration in reference is narrated from al-Mughirah bin Shu`bah (may Allah be pleased with him) and is acceptable[2] and can be found in Sunan at-Tirmidhi [99][3], Sunan Ibn Majah [559-60], Sunan Abi Dawud, 159, Sunan an-Nasai [130] Sharh Ma`ani al-Aathar [1: 159][4], Musnad al-Imam Ahmad.

  1. The various modes of reciting the Holy Qur`an, and the principles for which, are well known to the students of knowledge and the scholars. The explanation to the mode of recitation in reference has been clearly explained by the great scholars of Tafsir and Arabic language and thus does not contradict the Holy Qur`an at all.

The question in reference is irrelevant of the mode adopted in recitation, the reason for which is mentioned below[9].

Firstly, “arjulakum” is normally read with a nasab being the maf’ul bihi of “ighsilu” and thus necessitating washing. As for the mode in which “arjulakum” is read with a jarr, it will be the maf’ul bihi of “imsahu” facilitating wiping over the feet when wearing khuff.

Secondly, for even the recitation with nasb, it necessitates wiping also and that is because in “wamsahu biruusikum”, “ruusikum” is in the place of nasb but is majrur because it is preceded by a baa. Since “arjulakum” is ma’tuf of “ruusikum” it is mansub due to imitation of its place and would be majrur if it is ma’tuf on the apparent word “ruusi” rather than its place; and this is the well-known conclusion of the grammarians.

It is possible that the amil causing arjulakum to be mansub is “imsahu” (wipe) and it is also possible that is “ighsilu” (wash); however when two amils act upon one word the one closer is preferred therefore the amil of arjulakum is “imsahu” (wipe). So it is established that the recitation with nasb, “arjulakum” necessitates wiping (when wearing Khuff or thick Jawrab) as well as washing.

قد بين ذلك ما حدثنا علي بن معبد قال : ثنا المعلى بن منصور قال : ثنا عيسى بن يونس ، عن أبي سنان ، عن الضحاك بن عبد الرحمن ، عن أبي موسى { أن رسول الله صلى الله عليه وسلم ، مسح على جوربيه ونعليه } .

حدثنا أبو بكرة وابن مرزوق قالا : ثنا أبو عاصم ، عن سفيان الثوري ، عن أبي قيس ، عن هذيل بن شرحبيل ، عن المغيرة بن شعبة ، عن رسول الله صلى الله عليه وسلم بمثله ..

فإن كان كما قال أبو موسى والمغيرة ، فإنا نقول بذلك ، لأنا لا نرى بأسا بالمسح على الجوربين ، إذا كانا صفيقين:

قال (وأما المسح على الجوربين فإن كانا

ثخينين منعلين يجوز المسح عليهما) لأن مواظبة المشي سفرا بهما ممكن وإن كانا رقيقين لا يجوز المسح عليهما؛ لأنهما بمنزلة اللفافة وإن كانا ثخينين غير منعلين لا يجوز المسح عليهما عند أبي حنيفة - رحمه الله تعالى -؛ لأن مواظبة المشي بهما سفرا غير ممكن فكانا بمنزلة الجورب الرقيق وعلى قول أبي يوسف ومحمد رحمهما الله تعالى يجوز المسح عليهما وحكي أن أبا حنيفة - رحمه الله تعالى - في مرضه مسح على جوربيه ثم قال لعواده فعلت ما كنت أمنع الناس عنه فاستدلوا به على رجوعه وحجتهما حديث أبي موسى الأشعري - رضي الله تعالى عنه - وأرضاه أن النبي - صلى الله عليه وسلم - مسح جوربيه وقد روي المسح على الجورب عن أبي بكر وعلي وأنس - رضي الله تعالى عنهم - وتأويله عند أبي حنيفة - رحمه الله تعالى - أنه كان منعلا أو مجلدا، والثخين من الجورب أن يستمسك على الساق من غير أن يشده بشيء. والصحيح من المذهب جواز المسح على الخفاف المتخذة من اللبود التركية؛ لأن مواظبة المشي فيها سفرا ممكن

وأما المسح على الجوربين، فإن كانا مجلدين، أو منعلين، يجزيه بلا خلاف عند أصحابنا وإن لم يكونا مجلدين، ولا منعلين، فإن كانا رقيقين يشفان الماء، لا يجوز المسح عليهما بالإجماع، وإن كانا ثخينين لا يجوز عند أبي حنيفة وعند أبي يوسف، ومحمد يجوز.

وروي عن أبي حنيفة أنه رجع إلى قولهما في آخر عمره، وذلك أنه مسح على جوربيه في مرضه، ثم قال لعواده: " فعلت ما كنت أمنع الناس عنه " فاستدلوا به على رجوعه، وعند الشافعي لا يجوز المسح على الجوارب، وإن كانت منعلة، إلا إذا كانت مجلدة إلى الكعبين، احتج أبو يوسف، ومحمد بحديث المغيرة بن شعبة، أن «النبي - صلى الله عليه وسلم - توضأ، ومسح على الجوربين» ؛ ولأن الجواز في الخف لدفع الحرج لما يلحقه من المشقة بالنزع، وهذا المعنى موجود في الجورب، بخلاف اللفافة، والمكعب؛ لأنه لا مشقة في نزعهما

وأما حديث المغيرة بن شعبة فروي من طريق أبي قيس عن هذيل بن شرحبيل، عن المغيرة بن شعبة، «أن النبي - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - توضأ ومسح على الجوربين والنعلين» .

وقال الترمذي: حديث حسن صحيح،

وأما المسح على الجوربين فهو على أقسام ثلاثة إن كانا مجلدين أو منعلين جاز المسح بإجماع بين أصحابنا

وأما إذا كانا غير منعلين فإن كانا رقيقين بحيث يرى ما تحتهما لا يجوز المسح عليهما

وإن كانا ثخينيين قال أبو حنيفة لا يجوز المسح عليهما وقال أبو يوسف ومحمد يجوز

وروي عن أبي حنيفة أنه رجع إلى قولهما في آخر عمره
