Should a sinful person be allowed to offer public services?

Question:

Respected Mufti saheb, Assalamu Alaykum

It is my sincere dua that this letter reaches Mufti Saheb in the best of condition. May Allah keep Mufti Saheb healthy and accept Mufti Saheb`s sterling efforts. Respected Mufti Saheb your guidance on the following will be highly appreciated:

The community has serving on its burial committee a youngster from our area whose job description is as follows:

  • Driving the hearse
  • Digging and arranging Qabrs
  • Assisting with ghusl
  • Assisting at the graveside

This youngster is unfortunately involved in the following:

  • Uses foul language, even whilst assisting with Janazas
  • Involved in Haraam relationship
  • Involved in fraudulent business activity.

My question are as follows:

  1. Is it correct for the our ommunity to allow such a youngster to continue serving on the burial committee?
  2. Should he continue service, will the Trustess be sinful and answerable on the day of Qiyaamah?
  3. Should he carry on serving, will it be correct for me to make a bequest that he should not assist with my burial?

Mufti Saheb, kindly assist. JazakAllah and continue remembering us in your duaas.

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We refer to your hand-delivered letter in the latter part of January 2014. We make dua Allah Ta`ala accept all your services on behalf of your community and may Allah Ta`ala make your services a means of forgiveness and His mercy in the hereafter. Ameen

The youngster in reference should be commended for his public services and he should be assisted to reform his conduct on the issues in reference.

The services of the youngster is not pertaining to issues of direct Ibadat, for example performing salah etc. He is engaged in public services. Therefore his inappropriate conduct does not disqualify him from continuing his services[1].

It is my humble advice that, as a senior person of the community, you should consider some effective ways to assist the youngster to redress his conduct. Draw him closer through tolerance and compassion. Love has a potential to soften a person and accept advises.

The challenge for seniors is in making our youth assets for our community. For that, tolerance and forgiveness is most important. The community services rendered by our youngsters through our perseverance and guidance could be our “thawab-e-jariyah” (continuous reward) and means of our forgiveness.
