Insurance, Interest and Salat al-Hajah

Shortened Question:

Is it permissible to take out insurance with a company paying for it?

Who can interest money be given to?

I live in the U.S. and follow Hanafi fiqh- 1. Company where my husband works offers life insurance at no cost for employees (but company itself deals with insurance company). Is this insurance halal to take? Is it more taqwah to refuse this insurance?

  1. Interest money that is supposed to be given to poor without expecting any reward, should it be given to poor muslims or poor non-muslims? If given to muslims, would this dirty money decrease their strength to worship? If parents are poor, could this be given to them?
  2. Salat ul haajah mentioned in at targhib wa tarheeb made of twelve rakaats with salaam after each two rakaats. After salaam of last two rakaats go back to sajdah recite 7 x surah Fatiha, 7 x ayaatul kursiy, 10 x laa ilahaa illa lahu wahdahu la sharikala … and then make dua. Is this salah authentic? Could it be prayed?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, it is harām to take out any insurance, including a life insurance policy, since it constitutes ribā (interest),[1] qimār (gambling)[2] and gharar (excessive uncertainty)[3] all of which are prohibited in Islam[4].

In reference to your query, we understand that the company your husband is working for is providing the benefit of a life insurance, and the employee does not make any contribution to the premium. As such, it will be permissible to benefit from the insurance facility provided by the company. This benefit will be regarded as a gratuity provided by the company to the employees, and the ruling will be similar to the bonus given to employees at the end of the year by some companies.[5] Nevertheless, if the concept is different to what we have understood, you may resend the question explaining the procedure in detail.

The interest money may be given as charity to any Muslim or non-Muslim[6], including parents[7], as long as they are poor and do not possess the nisab (threshold) of zakāh[8]. While the interest money should be given as charity to relieve oneself from the burden of an unlawful excess; it will not be regarded as unclean or contaminated for the needy person who receives it as charity and thus it will not impact on his worship[9].

The narration in reference is unreliable[10].

You may adopt the following method to observe Salāt al-Hājah[11]:

  • Make perfect ablution
  • Observe two rak`āt salāh
  • Praise Allah
  • Send salutations on Prophet Muhammad (peace be upon him)
  • Recite the following supplication:

 

لاإله إلا الله الحليم الكريم سبحان الله رب العرش العظيم الحمد لله رب العالمين أسئلك موجبات رحمتك وعزائم مغفرتك والغنيمة من كل بر والسلامة من كل إثم لا تدع لي ذنبا الا غفرته ولا هما إلا فرجته ولا حاجة هي لك رضا إلا قضيتها يا أرحم الراحمين

 

Transliteration: Laa ilaaha illallaahul haleemul kareem subhanallahi Rabbil arshil azeem alhamdu lillahi Rabbil aalameen as`aluka moojibaati rahmatika wa azaa`ima maghfiratika wal ganeemata min kulli birrin was salaamata min kulli ithmin laa tada` lee zamban illa ghafartahu wa laa hamman illa farrajtahu wa laa haajatan hiya laka riza illa qadhaytahaa ya arhamar Raahemeen.

 

Translation: There is no deity but Allah the Clement and Wise. Pure is Allah, Lord of the Tremendous Throne.  All praise is to Allah, Lord of the worlds.  I ask you (O Allah) everything that leads to your mercy, and your tremendous forgiveness, enrichment in all good, and freedom from all sin.  Do not leave a sin of mine (O Allah), except that you forgive it, nor any concern except that You create for it an opening, nor any need in which there is your good pleasure except that you fulfill it, O Most Merciful. [Sunan at-Tirmidhi, 477]

فإن شرطوا لذلك جعلاً، فإن شرطوا الجعل من الجانبين فهو حرام.

وصورة ذلك: أن يقول الرجل لغيره: تعال حتى نتسابق، فإن سبق فرسك، أو قال: إبلك أو قال: سهمك أعطيك كذا، وإن سبق فرسي، أو قال: إبلي، أو قال: سهمي أعطني كذا، وهذا هو القمار بعينه؛ وهذا لأن القمار مشتق من القمر الذي يزداد وينقص، سمي القمار قماراً؛ لأن كل واحد من المقامرين ممن يجوز أن يذهب ماله إلى صاحبه، ويستفيد مال صاحبه، فيزداد مال كل واحد منهما مرة وينتقص أخرى، فإذا كان المال مشروطاً من الجانبين كان قماراً، والقمار حرام، ولأن فيه تعليق تمليك المال بالخطر، وإنه لا يجوز.

"و" ندب "صلاة الحاجة" وهي ركعتان. عن عبد الله بن أبي أوفى قال رسول الله صلى الله عليه وسلم: "من كانت له حاجة إلى الله تعالى أو إلى أحد من بني آدم فليتوضأ وليحسن الوضوء ثم ليصل ركعتين ثم ليثني على الله وليصلي على النبي صلى الله عليه وسلم ثم ليقل لا إله إلا الله الحليم الكريم سبحان رب العرش العظيم الحمد لله رب العالمين أسألك موجبات رحمتك وعزائم مغفرتك والغنيمة من كل بر والسلامة من كل إثم لا تدع لي ذنبا إلا غفرته ولا هما إلا فرجته ولا حاجة لك فيها رضى إلا قضيتها يا أرحم الراحمين"

صلاة الحاجة وهي ركعتان كما ذكره في شرح منية المصلي مع ما قبله من الاستخارة والأحاديث بها مذكورة في الترغيب والترهيب

(قوله وأربع صلاة الحاجة إلخ) قال الشيخ إسماعيل: ومن المندوبات صلاة الحاجة، ذكرها في التجنيس والملتقط وخزانة الفتاوى وكثير من الفتاوى والحاوي وشرح المنية. أما في الحاوي فذكر أنها ثنتا عشرة ركعة، وبين كيفيتها بما فيه كلام. وأما في التجنيس وغيره، فذكر أنها أربع ركعات بعد العشاء وأن في الحديث المرفوع يقرأ في الأولى الفاتحة مرة وآية الكرسي ثلاثا، وفي كل من الثلاثة الباقية يقرأ الفاتحة والإخلاص والمعوذتين مرة مرة كن له مثلهن من ليلة القدر. قال مشايخنا: صلينا هذه الصلاة فقضيت حوائجنا مذكور في الملتقط والتجنيس وكثير من الفتاوى، كذا في خزانة الفتاوى. وأما في شرح المنية فذكر أنها ركعتان، والأحاديث فيها مذكورة في الترغيب والترهيب كما في البحر.

وأخرج الترمذي عن عبد الله بن أبي أوفى قال: قال رسول الله - صلى الله عليه وسلم - «من كانت له إلى الله حاجة أو إلى أحد من بني آدم فليتوضأ وليحسن الوضوء ثم ليصل ركعتين، ثم ليثن على الله تعالى، وليصل على النبي - صلى الله عليه وسلم - ثم ليقل لا إله إلا الله الحليم الكريم، سبحان الله رب العرش العظيم، الحمد لله رب العالمين. أسألك موجبات رحمتك، وعزائم مغفرتك، والغنيمة من كل بر، والسلامة من كل إثم، لا تدع لي ذنبا إلا غفرته، ولا هما إلا فرجته، ولا حاجة هي لك رضا إلا قضيتها يا أرحم الراحمين» . اهـ.

أقول: وقد عقد في آخر الحلية فصلا مستقلا لصلاة الحاجة، وذكر ما فيها من الكيفيات والروايات والأدعية وأطال وأطاب كما هو عادته - رحمه الله تعالى - فليراجعه من أراده.
